Terms of Service

1. About Shughuli

Shughuli (“we”, “us”, “our”) is an online marketplace that connects customers with local service providers in Kenya. We do not provide services ourselves — we facilitate discovery and booking between customers and independent businesses.

2. Acceptance of Terms

By accessing or using the Shughuli platform (website, mobile site, or any related services), you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.

3. User Accounts

• You must provide accurate, current information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to register as a service provider.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. For Customers

• Browsing and booking on Shughuli is free of charge.
• A booking is a request to a service provider — confirmation depends on the provider’s availability.
• You agree to provide a valid phone number so providers can reach you regarding your booking.
• Cancellations and rescheduling are subject to the individual provider’s policy.
• Shughuli is not liable for the quality, safety, or legality of services provided by third-party businesses.

5. For Service Providers

• Listing a business on Shughuli is currently free.
• You represent that you have the legal right to offer the services you list.
• You are solely responsible for the accuracy of your business information, pricing, and availability.
• You agree to honour confirmed bookings or communicate changes to the customer promptly.
• Shughuli may suspend or remove listings that receive repeated complaints or violate platform policies.
• You must comply with all applicable Kenyan laws, including business licensing and tax obligations.

6. Payments

Where payment is facilitated through the platform (e.g. M-Pesa), Shughuli acts as an intermediary. Payments are processed by third-party payment providers and are subject to their terms. Shughuli does not store card or mobile money credentials.

7. Complaints & Disputes

If you have a complaint about a service received, you may file a dispute through the platform. We will facilitate communication between parties but are not obligated to resolve disputes. For unresolved matters, Kenyan consumer protection laws apply.

8. Prohibited Conduct

You agree not to:

• Use the platform for unlawful purposes or to list illegal services.
• Impersonate another person or business.
• Harass, abuse, or threaten other users.
• Attempt to scrape, reverse-engineer, or disrupt the platform.
• Post false or misleading information.

9. Intellectual Property

The Shughuli name, logo, and platform design are our intellectual property. Content you upload (business descriptions, images) remains yours, but you grant us a non-exclusive licence to display it on the platform.

10. Limitation of Liability

Shughuli is provided “as is” without warranty of any kind. To the maximum extent permitted by Kenyan law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to loss of profits, data, or business opportunities.

11. Modifications

We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance. We will notify registered users of material changes via email or platform notification.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
